The Terms and Conditions as set out herein constitute an understanding or agreement between M/s Hija Jewels & Company ("HIJA",’’company ‘"we", "us" or "our"), which is owner or operates the Platform/website of one side and a natural or legal person who accesses or visits or uses this Platform in any manner ("you" , “customer’ "your") on the other side.
Website includes all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated herein.
After using the Platform / website, you expressly agree to be legally bound by the Terms and conditions (“Terms of Service”, “Terms”) as stated herein.
These Terms of Service shall be applied to all users of the website, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
2. Product Warranties or Guarantee
The company gives no warranties, or guarantees (whether express, implied in law or residual) relating to any products offered or listed on the website. The company disclaim any warranty or guarantee in relation to any product offered or listed on the Website or platform. In particular, that all products listed on the Website are subject to availability and minor differences up to 3% in colour and/ or appearance between the products listing on the Website.
You shall not render or serve any claim on the company in any circumstances if there is no availability of products or having a minor difference of colour and/ or appearance between the products as listed on the Website and delivered to you.
3. Trademarks or logos or Intellectual Property
The Company owns all Intellectual Property Rights of the Website, including all rights, title and interest, copyright, utility models, trademarks, trade names, logos, designs, text, content, and graphics etc.
You acknowledge and agree that you shall not use, reproduce or distribute or share or disclose any content, text, pictures and video from the Website without taking approval/permission from the company. The trademarks, names, and logos displayed on this website are registered / unregistered trademarks of the website owner.
4. Purchases made on the Website
These Terms and conditions apply to you by using company Website. Product listings on the Website do not amount to an offer by the company or a legally binding contract. The contract for purchase of any such product is completed when we confirm acceptance of your order.
5. Prices
For sale in India, prices displayed for products on the Website may be inclusive of Taxes (GST) and if not, then such GST shall be added separately to the customer account. All the prices are in Indian Rupees (INR). Hija reserve the right to recover or charge shipping fee as extra over an amount as mentioned on the website.
6.Payments
The company will accept the following payment in the following ways:
(i) Credit/ debit cards of all leading banks.
(ii) By way of Net banking payments
(iii) any UPI methods
(iv) Cash on delivery up to a maximum limit of 2000/ INR
7. Levy of Cancellation fee
If a customer cancels the purchase order after making the payment, then company may levy a cancellation fee if the shipping is in process. This cancellation fee will be displayed on the Website before you confirm your cancellation order.
8 .Product ownership
All Products will remain company ownership until you have paid full amounts due to us under the agreement for any purchase made under this website, including payment of shipping charges. You may not be allowed to sell any of the Product before full ownership has been passed /transferred to you.
9. Delivery of products
The customer is responsible for providing or made available to us all accurate and true information and details for the purposes of delivery of products, including name, address and other contact details if required. If the details provided are incomplete or false, it may cause delay of delivery or otherwise may lead to cancellation of your order, along with levy of a cancellation fee.
10. Free Gift items and discount
All free gift product offered herein may be treated as discounts. In Case of Partial or full Cancellation of Orders with a Free gift, the Amount refunded will not include the discount attributed to the Free Gift.
11. Using company Website and its Services
You acknowledge and agree that the products listed on the Website may display or exhibit all the related information's. if it is necessary website may include information like music, photographs, short video clip, or other materials information ("Content"), which has been uploaded, posted, or otherwise made available on the website by third party or parties. All these contents showing on the website is the sole responsibility of the person from where these Content generated. We cannot control these Content generating from third parties, so that we do not give guarantee to any one for the accuracy, truthiness, integrity or quality of these Content.
Website users also agree and acknowledge that you shall not use the Website for carry out any work or activity which is unlawful or illegal and also agree not to download, upload, post, or otherwise make available any of website Content, which is unlawful, or illegal or otherwise objectionable.
12. Computer generated invoicing or billing
The company shall issue an invoice electronically as required by law, we reserve the right to issue or make available electronic invoices and the customer has agreed and acknowledged for it. This electronic invoice or records are generated by the use of a computer system, and it does not require any physical or digital signatures on its records or invoice.
*13. Warranty Clause
We offer a limited six-month warranty on our Jewellery products only and this warranty is valid for a period of six months from the date of purchase and all these products which were purchased from our online Store namely www.hijajewels.com
This warranty covers only pre-existing damages or manufacturing defects and does not cover any wear and tear in due course.
This warranty does not cover:
• Damage resulting from improper care, misuse, accidents, or neglect (e.g., scratches, dents, bending, or damage from exposure to chemicals, cleaning agents, perfumes, lotions, etc.)., mishandling, impact damage, modification, alterations, tampering, etc and surface finish/color of the product and loss or missing of any parts or falling of stones from the product item.
• Normal wear and tear, including but not limited to fading, tarnishing, or stretching
• Repairs or alterations made by you or any third parties.
• Loss or theft of the jewelry.
• Damage from resizing or other modifications not performed by the company.
The warranty covers repairs or, at our discretion, replacement of the defective Product.
In case if we are unable to repair the item, the company will, at its sole discretion, replace the item with any other item of equal value & amount.
Any item found to be defective under this warranty clause may be, at our discretion to replace by the similar item if stock item is not available with the company.
The damaged product should be sent by post or courier to the company address at your cost and expenses. You are liable to bear for shipping costs associated with returning or sending back the jewelry under the warranty clause.
This warranty is non-transferable and applies only to the original purchaser of the Product.
. No other warranties, expressed or implied, are made by the company except as stated herein.
The company reserves the right to amend or modify or change or withdraw warranty clause in the future at its discretion at any time without any prior notice.
The company shall not liable to you or to any third-party for any modification, change, suspension or discontinuance of the Service/warranty.
Free Plating warranty on Silver Jewelry:
You can avail re-plating services of HIJA branded Silver Jewelry products where you face a plating or tarnishing issue.
Plating warranty is valid for a period of 3 years from the date of purchase on eligible silver products which were purchased from our online Store www hijajewels.com
The product should be sent by post or courier to the company address at your cost and expenses. You are liable to bear for shipping costs associated with returning or sending back the jewelry under the plating warranty clause.
We re-plate all HIJA Silver jewelry except the ones with diamonds, pearls, or black beads or crystal or stone and warranty service is not applicable to multitone or multicolor jewellery, oxidized jewellery and coins, rakhis, God idols and utensils etc.
If the product does not qualify for re-plating, unfortunately, we will have to send it back to you.
This warranty is non-transferable and applies only to the original purchaser of the Product. No other warranties, expressed or implied, are made by the company except as stated herein
If you would like the pendant to be re-plated, please send the chain as well. We will re-plate both.
If you wish to get your earrings re-plated, kindly send us the pair and we'll take care of the rest.
HIJA reserves the right to amend or modify or change or withdraw or discontinue these warranty conditions in the future at its discretion at any time without any notice
The company shall not be liable to you or to any third-party for any modification, change, suspension or discontinuance of the Service/warranty.
14. Indemnification and limitation of liability
The website owner shall not be responsible for any loss or damage (whether direct or indirect or consequential), or for any personal injury or any expenses which may be incurred by you or any third party as a result of using website. The website owner will not responsible or liable to you for all such loss or damage or expenses incurred.
You agree and acknowledge to indemnify the Company and its officers for any claim or demand raised, including legal fee/Court fee and other expenses for any losses or damage suffered by the company
.In no case HIJA, our OWNER, officers, employees, agents, contractors, suppliers, service providers or licensors shall be liable for any injury, loss, claim, direct or indirect, incidental, or consequential damages of any kind arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product.
15. Conflict in any provision
If there is a conflict in the provisions of any terms and conditions, the other relevant provision of terms and conditions which relate to a particular section of the website shall prevail in respect of your use of the website
16. Severability clause
If any provision of these terms and conditions, which is becomes non enforceable under applicable law, and only to the extent that is so unenforceable, will be excluded from such terms and the remaining provisions of terms and conditions shall be valid and shall remain in full force and effect.
17. Governing Law and jurisdiction
These Terms and conditions or Privacy Policy shall be governed in accordance with the law force in India and the parties herein agree to it consented that the Courts located in New Delhi, India shall have exclusive jurisdiction over all controversies or disputes arising under this agreement or use of website.
18 Modification of the Terms of Service.
Prices of the company products displayed on the website are subject to change at any time without any prior notice to the customer.
The company reserve the right to modify or discontinue any service (or any part or content thereof) at any time without any prior notice.
The company reserve the right, at its sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to the website.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service or any part of its services.
19. Force Majeure Events
The company will not be held liable or responsible to you or any other party under any agreement for any delay in fulfilling our obligation or failure to comply or performing any terms and conditions, policies or services if the delay or failure arises from any cause which is beyond HIJA reasonable control.
Force majeure activities or incidents may include without any limitation such as acts of God, wars or invasion, Govt order of law, strikes or labour stoppage, natural disasters (e.g., flood, fire, explosion or earthquakes), terrorist attacks or riots, epidemics pandemic, etc.
20. Termination of services
The Company may, without prior notice and without any liability or compensation, immediately terminate, or suspend your access to the Website in case you breach or violate any of Terms or conditions contained herein which may include fraudulent or illegal activities etc.
21 Accuracy and Completeness of Information
The company is not responsible if information made available on this site is inaccurate or incomplete. 22 Cancellation of Order
The company reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department.
